Gan VID, gan nodokļu maksātāji turpmāk varēs paļauties, uz Senāta definēto brīdi, kas tiks uzskatīts par noteicošo atkārtotā nodokļu pārkāpuma kvalifikācijai. Trīs gadu termiņš, pēc kura no jauna izdarīts pārkāpums vairs nevar tikt kvalificēts kā atkārtots, jārēķina tieši no iepriekšējā pārkāpuma izdarīšanas, nevis no Valsts ieņēmumu dienesta (VID) lēmuma stāšanās spēkā.

    Grozījumi likumā “Par izložu un azartspēļu nodevu un nodokli” un grozījumi Azartspēļu un izložu likumā tiek virzīti likumprojekta “Par valsts budžetu 2025.gadam un budžeta ietvaru 2025., 2026. 2024.gada 8.oktobrī Ministru kabinets izskatīja grozījumus likumā “Par izložu un azartspēļu nodevu un nodokli”. 2023 gada decembrī publicēti grozījumi likumā “Par izložu un azartspēļu nodevu un nodokli”, kas stājās spēkā 2024. Saskaņā ar “Par iedzīvotāju ienākuma nodokli” vienreizēji azartspēļu vai izložu laimesti līdz 3000€ nav apliekami ar nodokli. 1 “Par likuma “Par iedzīvotāju ienākuma nodokli” 8.

    Vēl viens trūkums ir tas, ka azartspēļu laimesta nodoklis var radīt nevienlīdzību starp spēlētājiem. Tomēr Makao, kas ir viens no lielākajiem azartspēļu centriem pasaulē, azartspēļu operatori maksā ievērojamus nodokļus, bet spēlētājiem nav jāmaksā azartspēļu laimesta nodoklis par saviem laimestiem. Lielbritānijā, piemēram, azartspēļu laimesti netiek aplikti ar nodokli, jo azartspēļu laimesta nodoklis tiek iekasēts no azartspēļu operatoriem, nevis spēlētājiem. Šis azartspēļu laimesta nodoklis tiek piemērots visiem laimestiem, kas pārsniedz noteiktu summu, un spēlētājiem ir pienākums deklarēt šos ienākumus savās nodokļu deklarācijās.

    Kā varu saņemt laimestu, spēlējot tirdzniecības vietā?

    Likumdevējs ir samērojis spēlētāja tiesības uz īpašumu un sabiedrības interesi gan mazināt izložu un azartspēļu atkarības risku, gan gūt lielākus budžeta ieņēmumus no nodokļa maksājumiem. Tāpat nodokļu maksātājiem bijis problemātiski nodrošināt ar izložu un azartspēļu laimestu saistīto attaisnojuma dokumentu pievienošanu gada ienākumu deklarācijai, jo tie netika uzkrāti un bija grūti pierādīt to saistību ar konkrētu laimestu. Jau tad esot konstatēts risks, ka izložu un azartspēļu laimestu saņēmēji savās gada ienākumu deklarācijās laimestus nenorāda, jo ienākuma izmaksātājam nav bijis pienākuma laimestu reģistrēt un identificēt. Arī izskatāmajā lietā pieaicinātās personas – Finanšu ministrija un Biedrība – norāda, ka izložu un azartspēļu laimesti ir atkarīgi no veiksmes un tos nevar salīdzināt ar ienākumiem no saimnieciskās darbības.

    Daļa laimestu netiek aplikti ar nodokli!

    Ministru kabineta 2001.gada 26.jūnija noteikumu Nr.276 “Noteikumi par zemu nodokļu vai beznodokļu valstīm un teritorijām” (spēkā līdz 2017.gada 31.decembrim) (turpmāk – Ministru kabineta 2001.gada 26.jūnija noteikumi Nr.276) 1.punktā ir noteiktas zemu nodokļu vai beznodokļu valstis un teritorijas. Uzņēmumu ienākuma nodoklis tiek ieturēts no ienākumiem, kas minēti likuma “Par uzņēmumu ienākuma nodokli” 3.panta ceturtajā, astotajā un 8.2daļā. Ņemot vērā minēto, komersantiem, kas veic komercdarbību, kas saistīta ar virtuālās valūtas (kriptovalūtas) uzpirkšanu un izplatīšanu, pienākums ir kārtot grāmatvedību atbilstoši grāmatvedības uzskaiti reglamentējošo normatīvo aktu prasībām, nodrošinot likumā “Par grāmatvedību” noteiktās prasības attiecībā uz grāmatvedības kārtošanu. Grāmatvedībā uzskatāmi atspoguļojami visi uzņēmuma saimnieciskie darījumi, kā arī katrs fakts vai notikums, kas rada pārmaiņas uzņēmuma mantas stāvoklī (turpmāk — saimnieciskie darījumi). Likuma “Par grāmatvedību” 1.pants nosaka, ka likums attiecas uz komersantiem, kooperatīvajām sabiedrībām, ārvalstu komersantu filiālēm un nerezidentu (ārvalstu komersantu) pastāvīgajām pārstāvniecībām, biedrībām un nodibinājumiem, politiskajām organizācijām (partijām) un to apvienībām, reliģiskajām organizācijām, arodbiedrībām, iestādēm, kuras tiek finansētas no valsts budžeta vai pašvaldību budžetiem, uz valsts vai pašvaldību aģentūrām, citām juridiskajām un fiziskajām personām, kas veic saimniecisko darbību (turpmāk — uzņēmums). Jums jāuzskaita visi darījumi un jānosaka, vai esat guvis peļņu vai zaudējumus.
